1. Koşulların Kabulü

Yakın Park ("Uygulama", "biz") uygulamasını indirerek, hesap oluşturarak veya kullanarak bu Kullanım Koşulları'nı ("Koşullar") kabul etmiş olursun. Koşulları kabul etmiyorsan Uygulama'yı kullanma. Bu Koşullar, seninle bizim aramızda yasal olarak bağlayıcı bir sözleşmedir.

1. Acceptance of Terms

By downloading, creating an account on, or using the Yakın Park application ("the App", "we"), you agree to these Terms of Use ("Terms"). If you do not accept the Terms, do not use the App. These Terms form a legally binding agreement between you and us.

2. Hizmetin Tanımı

Yakın Park, park yerini boşaltan sürücü ile yer arayan sürücüyü aynı harita üzerinde buluşturan, topluluk temelli bir park paylaşım platformudur. Uygulama yalnızca kullanıcılar arasında bilgi paylaşımını kolaylaştırır; park yerlerinin sahibi, işleticisi veya garantörü değildir.

2. Description of the Service

Yakın Park is a community-based parking-sharing platform that connects a driver leaving a spot with a driver looking for one on the same map. The App only facilitates information sharing between users; it is not the owner, operator, or guarantor of any parking spot.

3. Hesap ve Uygunluk

• Uygulama'yı kullanmak için en az 18 yaşında olmalısın.
• Hesap bilgilerinin doğru ve güncel olmasından sen sorumlusun.
• Hesabının ve giriş bilgilerinin güvenliğinden sen sorumlusun.
• Hesabın altında gerçekleşen tüm etkinliklerden sen sorumlusun.

3. Account and Eligibility

• You must be at least 18 years old to use the App.
• You are responsible for keeping your account information accurate and current.
• You are responsible for the security of your account and credentials.
• You are responsible for all activity that occurs under your account.

4. Kullanıcı İçeriği ve Davranış Kuralları

Uygulama, park noktası fotoğrafı gibi kullanıcı içeriği paylaşmana izin verir. Paylaştığın içerikten tamamen sen sorumlusun.

Aşağıdakileri yapmamayı kabul edersin:

• Yasa dışı, zararlı, müstehcen veya başkalarının mahremiyetini ihlal eden içerik paylaşmak.
• Başka kullanıcıları taciz etmek, tehdit etmek veya onlara zorbalık yapmak.
• Sahte park yeri bildirimi yapmak veya ödül/puan sistemini suistimal etmek.
• Konum verisini veya doğrulama mekanizmasını manipüle etmek (GPS sahteciliği vb.).
• Başkasının kimliğine bürünmek veya yanıltıcı bilgi vermek.

Uygunsuz içeriği veya kullanıcıyı her park paylaşımındaki "Şikayet et" seçeneğiyle bildirebilir, "Engelle" ile bir kullanıcının tüm paylaşımlarını anında gizleyebilirsin. Şikayetler en geç 24 saat içinde incelenir ve ihlal eden içerik/kullanıcı kaldırılır.

4. User Content and Code of Conduct

The App allows you to share user content, such as parking-spot photos. You are fully responsible for the content you share.

You agree not to:

• Share illegal, harmful, obscene content or content that violates others' privacy.
• Harass, threaten, or bully other users.
• Post fake parking-spot reports or abuse the reward/points system.
• Manipulate location data or the verification mechanism (e.g., GPS spoofing).
• Impersonate others or provide misleading information.

You can report objectionable content or users via the "Report" option on every parking post, and instantly hide all of a user's posts via "Block". Reports are reviewed within 24 hours and violating content/users are removed.

5. Ödül ve Puan Sistemi

Uygulama, park yeri paylaşımını teşvik etmek için puan/ödül verebilir. Puanların nakit değeri yoktur, devredilemez ve yalnızca Uygulama içinde geçerlidir. Suistimal tespit edilmesi hâlinde puanları iptal etme ve hesabı askıya alma hakkımız saklıdır. Hediye Çarkı'na katılım ayrıca Ödül Programı Resmi Kuralları'na tabidir.

5. Reward and Points System

The App may grant points/rewards to encourage parking-spot sharing. Points have no cash value, are non-transferable, and are valid only within the App. We reserve the right to revoke points and suspend accounts if abuse is detected. Reward Wheel participation is also subject to the Official Reward Program Rules.

6. Sorumluluk Reddi

Aracını her zaman geçerli trafik kurallarına, levhalara ve yerel mevzuata uygun şekilde park etmekten yalnızca sen sorumlusun. Yanlış park nedeniyle doğabilecek ceza, çekilme, hasar veya anlaşmazlıklardan Yakın Park sorumlu değildir. Uygulama "olduğu gibi" sunulur; kesintisizlik veya hatasızlık garantisi verilmez.

6. Disclaimer

You are solely responsible for parking your vehicle in compliance with applicable traffic rules, signage, and local regulations at all times. Yakın Park is not liable for any fines, towing, damage, or disputes arising from improper parking. The App is provided "as is", without warranty of uninterrupted or error-free operation.

7. Sorumluluğun Sınırlandırılması

Yürürlükteki yasaların izin verdiği azami ölçüde, Yakın Park; Uygulama'yı kullanmandan veya kullanamamandan doğan dolaylı, arızi, özel veya sonuçsal zararlardan (kâr kaybı, veri kaybı, park cezası vb.) sorumlu tutulamaz.

7. Limitation of Liability

To the maximum extent permitted by law, Yakın Park shall not be liable for any indirect, incidental, special, or consequential damages (loss of profit, loss of data, parking fines, etc.) arising from your use or inability to use the App.

8. Fikri Mülkiyet

Uygulama'nın adı, logosu, tasarımı ve yazılımı dâhil tüm fikri mülkiyet hakları bize veya lisans verenlerimize aittir. Paylaştığın içerik sana ait kalır; ancak içeriği Uygulama'da gösterebilmemiz için bize dünya çapında, telifsiz, sınırlı bir kullanım lisansı vermiş olursun.

8. Intellectual Property

All intellectual property rights in the App, including its name, logo, design, and software, belong to us or our licensors. Content you share remains yours; however, you grant us a worldwide, royalty-free, limited license to display that content within the App.

9. Hesabın Sonlandırılması

Bu Koşulları ihlal etmen hâlinde hesabını uyarısız askıya alabilir veya sonlandırabiliriz. Sen de istediğin zaman Uygulama içinden Profil > Hesabı Sil ile hesabını kalıcı olarak silebilirsin.

9. Termination

We may suspend or terminate your account without notice if you violate these Terms. You may also permanently delete your account at any time from within the App via Profile > Delete Account.

10. Koşullardaki Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Güncel sürüm bu sayfada yayımlanır. Değişiklikten sonra Uygulama'yı kullanmaya devam etmen, yeni Koşulları kabul ettiğin anlamına gelir.

10. Changes to the Terms

We may update these Terms from time to time. The current version is published on this page. Continuing to use the App after a change means you accept the new Terms.

11. Geçerli Hukuk ve Uyuşmazlık

Bu Koşullar Türkiye Cumhuriyeti yasalarına tabidir. Uygulama'dan doğacak uyuşmazlıklarda İstanbul Mahkemeleri ve İcra Daireleri yetkilidir.

11. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of İstanbul shall have jurisdiction over disputes arising from the App.
